Privacy Statement

Eddie the EK respects that your privacy is important to you and ensures that the personal information you provide to us will always be protected. 

Use of Information

Eddie the EK requires your personal information for the purpose of requesting a booking. The personal information requested by Eddie the EK includes, but is not limited to: 

• Full Name 
• Phone Number
• Email Address
• Event Date 
• Arrival Time
• Pick-up and drop-off locations 

Eddie the EK does not keep records of customer credit card details as all payments are processed through Xero. 

We also collect cookies from your computer. 

Disclosure of Information

The information we collect from you is strictly confidential. Eddie the EK will not disclose your personal information to any third parties, other than those who are contracted to us to keep the information confidential.

 The Eddie the EK website utilise cookies to store information of browsing history and to enable browsing features. We do not store any personal or financial information about customer-used cookies.

 Under no circumstances will Eddie the EK sell or receive payments or services for disclosing customer's personal information to any partner or external company. 

Eddie the EK is owned and operated by Laurene Algate (ABN: 79 225 159 206). By booking and paying the non-refundable deposit you agree to the following terms and conditions. 

Booking Date 

The booking date is only secured when the non-refundable deposit is paid and cleared into Eddie the EK’s bank account, and the hirer has agreed to the booking terms and conditions. 

Booking update/changes 

The hirer must update Eddie the EK in writing of any changes to event details at least 7 days prior to the booking date, including but not limited to, the event date, time and location. Eddie the EK takes no responsibility for event changes not communicated to Eddie the EK and shall be entitled to keep any monies paid.

Cancellation 

If the hirer cancels before the booking date, the following cancellation fees apply:  

• Cancellation after final payment has been made (within 4 weeks of booking date)
Loss of 100% of the total booking fee. 
• Cancellation before final payment has been made, but after deposit has been paid (over 4 weeks of from booking date)
Loss of non-refundable deposit. 

If Eddie the EK cancels the booking the hirer is entitled to a 100% refund, including the non-refundable deposit. 

Change of package type booked 

If the hirer changes the package type before final payment is due, the booking and final payment amount will be updated and reflected on the final payment invoice. 

If the hirer changes the package type after the final payment has been made to a package of a higher value, the difference is due immediately. Eddie the EK will update the booking once the difference payment has been received. If no payment is received, the original package type will apply on the booking date. 

If the hirer downgrades the package type after the final payment has been made, the hirer agrees no refund of the price difference will be offered.

Children

The hirer agrees and accepts that children under the age of 7, or children who require a car/booster seat, are unable to ride in Eddie the EK.

Choice of Law 

This agreement shall be governed by the laws of the State of Queensland, notwithstanding its conflicts of laws provisions.

Damage to vehicle

The hirer is fully responsible for all their guests (and third parties) who enter, ride or interact with Eddie the EK and for any damage caused by said, accidental or otherwise. The full cost of repair or replacement will be charged to the hirer post the event via invoice. 

Delays, breakdowns and accidents 

In the unlikely event of a road vehicle accident or mechanical break down, we will do our best to get the passengers to the destination with alternative transportation and refund the hire fee to the hirer. 

The hirer accepts that Eddie the EK will not be liable for any loss that the hirer may incur due to the vehicle breaking down, road accident, delay by traffic or other unforeseen events or incidents on public roads.

Deposit

A non-refundable $150 deposit is required to secure a booking. 

Driving Distance/Booking time

Unless negotiated before booking, the hirer agrees that the pick-up and drop-off points for the event are within the specified council areas and that the package chosen allows enough time for the transfer and photography time (if applicable). Eddie the EK remain the right to leave at the end of the booked package time period. The booking time begins upon arrival of Eddie the EK to the specified pick-up location. 

Final Payment

The hirer must pay the final payment 4 weeks prior to the event, otherwise Eddie the EK reserve the right to cancel the booking keep the non-refunable deposit.

Force Majeure

 If the driver is unable to attend the event due to fire, flood, casualty, strike, civil disturbance, war, terrorism, driver’s sickness, or other acts of God beyond the driver’s control, then Eddie the EK shall return all monies paid by the hirer and this agreement shall immediately terminate.

Jurisdiction

 The state and federal courts serving Queensland, Australia shall have exclusive jurisdiction over disputes arising from this agreement, and both parties here to consent to the jurisdiction of such courts.

Photography

All photo and video taken Eddie the EK staff is exclusively available for use on Eddie the EK’s website and social media platforms. The hirer can request prior to the event in writing if they wish for their event not to be used on Eddie the EK’s website or social media platforms.

Pricing

All prices are listed in Australian Dollars (AUD) and are inclusive of GST.

Rescheduling 

 If the hirer reschedules before the booking date, the following fees apply:  

• Rescheduling after final payment has been made (within 4 weeks of booking date) 
 Eddie the EK remain the right to charge a rescheduling fee of $150. All monies paid for the original booking date are non-refundable and will transfer over to the new booking date.
• Rescheduling before final payment has been made (over 4 weeks from booking date) 
 No rescheduling fee applies. 

If Eddie the EK is not available on the new booking date, the booking becomes a cancellation and the applicable cancellation fees apply.

Rules 

If any passenger(s) act in an unlawful manner, break any road rules, or abuses or threaten the driver, the driver remains the right to end the journey and the hirer forfeits all monies paid and is responsible for the remainder of their transfer and/or event. 

No outside food or drink is to be consumed in the vehicle, other than water and mints provided by Eddie the EK. 

Solicitor’s Fees

The prevailing party in any litigation or dispute involving this agreement, or the services performed there under, shall be entitled to recover reasonable solicitor’s fees, costs, and expenses arising from such litigation or dispute from non-prevailing party.

Term 

The term of this agreement commences upon the hirer executing this agreement, and terminates at the end of the booking period. 

Vehicle access/Indemnification

No responsibility will be accepted for restrictions relating to vehicle access at any location. It is the hirer’s responsibility to ensure Eddie the EK can access the required areas/locations, otherwise passengers will be dropped off at the closest restriction free location. 

The hirer acknowledges that the driver may be limited by the guidelines or rules of the location where Eddie the EK is going, and to hold driver and Eddie the EK harmless for the impact such restrictions may have on the service provided.

Waiver/Miscellaneous 

This agreement represents the complete and entire agreement of the parties with respect to the subject matter herein, notwithstanding any oral or written representations to the contrary made before, during, or after its execution. Any amendments to this agreement shall only be effective if made in writing that is executed by both parties hereto.
